Legislative Overview
Law No. 23 of 1951 regulates the practice of the profession of patent agents in Egypt and establishes the requirements that must be satisfied by individuals seeking registration in the Register of Patent Agents in order to practice the profession. The Law provides a legal framework for patent agents to exercise their professional functions, including representing interested parties before the competent authorities, subject to the applicable legal provisions governing the profession.
The Law addresses the conditions for registration in the Register of Patent Agents, the procedures for submitting and examining registration applications, and the authorities responsible for considering such applications. It also establishes the professional obligations of patent agents and the rules they must observe in the course of their practice. Furthermore, the Law regulates the disciplinary accountability of patent agents and the sanctions that may be imposed for breaches of their professional obligations, in addition to provisions concerning the unauthorized practice of the profession without satisfying the applicable legal requirements.
The Law was amended by Law No. 38 of 1961, which revised certain of its provisions and consequently affected the application of the rules governing the practice of the profession. As amended, Law No. 23 of 1951 remains one of the legislative instruments governing the professional and procedural aspects of patent agency practice in Egypt.
Legislative Framework
Law No. 23 of 1951 on the Practice of the Profession of Patent Agents, as amended by Law No. 38 of 1961, should be read in conjunction with the Egyptian legislative framework governing the protection of intellectual property rights, particularly Law No. 82 of 2002 on the Protection of Intellectual Property Rights, as amended, and Law No. 163 of 2023 establishing the Egyptian Intellectual Property Authority, together with the relevant implementing regulations and regulatory decisions.
Law No. 23 of 1951 establishes the legal framework for the practice of the profession of patent agents and the requirements for registration in the relevant register. Law No. 82 of 2002, in turn, addresses the substantive legal provisions governing the protection of intellectual property rights, including patents, and the procedures for protecting such rights in accordance with its provisions. Law No. 163 of 2023 establishes the Egyptian Intellectual Property Authority and defines its institutional mandate in the field of intellectual property.
Accordingly, these legislative instruments operate together to regulate the professional, institutional, and substantive aspects associated with patent protection in Egypt, each within the scope of its respective provisions and applicable amendments.
