Legislative Overview
Law No. 82 of 2002 on the Protection of Intellectual Property Rights establishes the legal framework for the protection of intellectual property rights in Egypt. It covers patents, utility models, layout-designs of integrated circuits, undisclosed information, trademarks, trade names, geographical indications, industrial designs, copyright and related rights, and the protection of plant varieties. The Law sets out the conditions and provisions governing the acquisition of these rights, the scope of their protection and exploitation, and the legal mechanisms available for their protection and enforcement.
The Law addresses matters relating to the registration of certain intellectual property rights and the applicable procedures, the rights and obligations of right holders, limitations and exceptions to protection, and sanctions applicable to certain infringements of protected rights. It constitutes the principal legislative framework for the protection of intellectual property rights in Egypt, subject to its provisions and amendments and the relevant legislation and implementing regulations.
Legislative Framework
Law No. 82 of 2002 on the Protection of Intellectual Property Rights, as amended, should be read in conjunction with the Egyptian legislative framework governing intellectual property protection, including Article 69 of the Egyptian Constitution, the relevant international treaties to which Egypt is a party, and the implementing regulations and regulatory decisions issued pursuant to its provisions. It should also be read alongside Law No. 163 of 2023 establishing the Egyptian Intellectual Property Authority, which governs the institutional framework for intellectual property in Egypt.
Law No. 82 of 2002 regulates the substantive legal provisions governing the protection of the various categories of intellectual property, including the conditions for protection, the scope of rights, the registration procedures applicable to rights for which registration is required, and the available legal remedies. Law No. 163 of 2023, in turn, establishes the institutional framework of the Egyptian Intellectual Property Authority and defines its functions and powers in accordance with its provisions. These legislative instruments operate alongside the relevant implementing regulations, regulatory decisions, and other applicable legislation, each within the scope of its respective provisions and prescribed functions.
